Diane Quartly Agreements

Prior to purchasing services, products or courses from Diane Quartly or using dianequartly.com, you agree to these conditions. Please read them carefully.

Non-Disclosure Agreement:

The non-disclosure agreement is considered binding upon submitting this application and is made between Client (you) and Diane Quartly.

This Agreement shall govern the conditions of disclosure by Diane Quartly the client of certain Confidential Information, including but not limited to course material, trade secrets and intellectual property relating to Diane Quartly services, products, and courses.

The Client hereby agrees that:

The Client shall not disclose any business or personal information given verbally or in written form during the course of study, including but not excluded to, cost information, accounting and unpublished financial information, business plans, customer lists and customer information, purchasing techniques, supplier lists and supplier information and marketing, production or merchandising systems or plans, information relating to persons Diane Quartly or any other persons mentioned or alluded to during the course.
The Client shall not directly or indirectly acquire any interest in, or design, create, manufacture, sell, teach or otherwise deal with any item or product, containing, based upon or derived from the information, except as may be expressly agreed to in writing by Diane Quartly.
That the secrecy obligations of The Client shall continue for a period ending 10 years from the date hereof.

Diane Quartly will be entitled to obtain an injunction to prevent threatened or continued violation of this Agreement, but failure to enforce this agreement will not be deemed a waiver of this Agreement.

This agreement is made for the Diane Quartly service, product, and courses both online and in-person between Client (you) and Diane Quartly.

This Agreement shall govern the conditions of disclosure by Diane Quartly and The Client of certain Confidential Information, including but not limited to course material, trade secrets and intellectual property relating to the Diane Quartly service, product or courses.

I understand that in taking a Diane Quartly service, product or course, I must take full responsibility for my course work and take ownership in my ability to take this class.

Time Zones: I understand that all communication about times and/or schedules via email, Facebook or website forum are always Mountain Daylight Time (GMT-6 and/or Edmonton Alberta).

Tech Pledge:

It is my sole responsibility to ensure I have access, use, and familiarity with all forms of technology required for my successful participation services, products, and courses. Although this type of career does deal mainly with people rather than computers, we feel that there are some computer skills essential for online courses, homework assignments, weekly videos, etc. Some of these include using websites like Vimeo, Box.com, Dropbox, YouTube, Adobe Flash Player, and other up-to-date software.

Homework: I understand that it is my responsibility to turn my homework in on a timely manner before the next lesson is given. I understand that my homework is due no later than the morning of the next session. I understand that Diane’s goal is to keep me on a timely path. Late homework exceptions are considered made for illness, emergencies, natural disasters, etc.

** Homework is required to be turned in using Word.

Terms & Conditions:

Online and In-person Courses:

All Diane Quartly purchases are final. We do not refund, transfer or defer and all courses, workshops, and classes must be completed as purchased and specified. Diane Quartly assumes no liability for lost, damaged or stolen personal items. Personal arrangements, including transportation to and from events, accommodation, and food, are the attendee’s own responsibility and risk. By attending Diane Quartly events you are confirming that you are in good physical condition and are willing to participate in events and workshops, and you assume all risks related to your participation. You release for yourself, your heirs and your executor any claim against Diane Quartly and its employees and agents from liability resulting from injury or accidents occurring during any Diane Quartly course, workshop or event.

Diane Quartly reserves the right to cancel a course within 21-days in advance of the program date. Participants will be notified of other program dates they may transfer to at no additional cost to the participant. Diane Quartly will not be responsible for any costs incurred due to cancellations. We recommend travel insurance for flights to courses. Diane Quartly assumes approval to use photographs that may be taken during your class, in promotional materials, unless otherwise notified by you.

In cases where Diane is a guest speaker or teacher offering courses, workshops, and events through other providers, all inquiries regarding bookings, attendance and terms and conditions must be made to the third-party organizer of the event. Diane Quartly is not responsible for the administration and production of these courses and events. Audio clips are the property of Diane Quartly and are protected by the Copyright law of Canada.

Non-disclosure forms are required to be signed and returned to Diane Quartly prior to the start of a course.

All content included in or made available by any Diane Quartly services and through dianequartly.com including text, images, graphics, logos, digital downloads, and audio clips is the property of Diane Quartly and is protected by the Copyright law of Canada.

Trademarks

Logos and names contained within this site are trademarks of Diane and may not be used in connection with any product or service, nor used in any manner that disparages or discredits Diane Quartly. Trademarks owned by Diane Quartly may be used only with the written permission of the trademark owner.

Refund policy

You may return new or unopened products items sold directly by Diane Quartly on dianequartly.com website within 30 days for a full refund. Refunds will not be given for downloaded files including but not limited to music, meditations, and courses.

Courses are non-transferable and must be completed as purchased & specified.

Items are shipped back to Diane Quartly at your own expense. We strongly advise that you purchase proof of postage, shipment tracking or insurance when you ship items for return as Diane Quartly will not be held responsible for any items which are lost by any mail carrier or courier.

Disclaimer of warranties

The information and products on this website are provided “as is” and “as available”. Diane Quartly makes no representations or warranties of any kind, expressed or implied, as to the operation of Diane Quartly’s services or the information, content, materials, products including downloaded files and software, or other services included on or otherwise made available to you through dianequartly.com, unless otherwise specified in writing.
